DOWNLOAD EBOOKExcerpt from A Manual of the Prevalence of Equity: Under the 25th Section of the Judicature Act, 1873, Amended by the Judicature Act, 1875 Eight and twenty years ago I protested, with all the energy I could command, in a Pamphlet, by some thought Utopian, by others premature, against the intolerable nuisance and unphilosophical absurdity of a Distinct Administration of Law and Equity. To-day, I find myself sitting down to edit a portion of an Act for its abolition! I confine myself to a single section (25). It alone has "amended and declared the Law to be hereafter administered in England," with reference to those great Principles of Equity, which are universally to "prevail." The rest of the Act is Procedure chiefly. It is hoped the following pages may be useful at least to the Common Law Branch of the Profession, which finds itself called on now for the first time to apply those Principles to Practice.
