C'EST LA PRESSION DES FAITS EN DEHORS DE TOUTE BASE JURIDIQUE, QUI CONDUIRA LA CEE EN 1972 A LANCER UNE POLITIQUE COMMUNAUTAIRE DE L'ENVIRONNEMENT ET A ADOPTER PONCTUELLEMENT DES MESURES JURIDIQUES QUI CONSTITUENT UN DROIT MATERIEL DE L'ENVIRONNEMENT. ENTRE EN VIGUEUR LE 1ER JUILLET 1987, L'ACTE UNIQUE EUROPEEN INTRODUIT EXPRESSEMENT L'ENVIRONNEMENT DANS LE TRAITE CEE PERMETTANT AINSI LE DEVELOPPEMENT D'UN VERITABLE DROIT COMMUNAUTAIRE DE L'ENVIRONNEMENT. MAIS, SI L'ACTE UNIQUE EUROPEEN DONNE AINSI UNE BASE LEGALE EXPLICITE A LA POLITIQUE COMMUNAUTAIRE DE L'ENVIRONNEMENT, C'EST LE TRAITE DE L'UNION EUROPEENNE QUI FAIT DE LA PROTECTION DE L'ENVIRONNEMENT L'UNE DES POLITIQUES FONDAMENTALES DE LA COMMUNAUTE ET FACILITE L'ADOPTION DE NOUVELLES MESURES. CEPENDANT, POUR FAIRE FACE AU DEFIT DES ANNEES 1990, CELUI DES ANNEES 1980 AYANT ETE LE MARCHE UNIQUE, LA COMMISSION DOIT RECOURIR A DE NOUVEAUX INSTRUMENTS JURIDIQUES.

This is the Seventh volume of the "Hague Yearbook of International Law," which succeeds the "Yearbook of the Association of Attenders and Alumni" "of the Hague Academy of International Law," The title "Hague Yearbook of International Law" reflects the close ties which have always existed between the AAA and the City of The Hague with its international law institutions and indicates the editors' intention to devote attention to developments taking place in those international law institutions, viz. the International Court of Justice, the International Criminal Tribunal for the Former Yugoslavia, the Permanent Court of Arbitration, the Iran-United States Claims Tribunal and the Hague Conference on Private International Law. The "Hague Yearbook" contains in-depth articles on these developments and summaries of (aspects of) decisions rendered by the International Court of Justice, the Permanent Court of Arbitration and the Iran-United States Claims Tribunal. This volume also contains the papers of the Regional AAA Congress, held in Siena, Italy, in May 1994.

The United Nations Convention on the Law of the Sea of 10 December 1982 entered into force on 16 November 1994. Since this date a single binding instrument has regulated the rights and duties of States at sea and regarding the sea. New concepts, such as the exclusive economic zone, archipelagic waters, transit passage through straits, and the International Seabed Area, are now fully recognized. The fifteen member States of the European Union are a significant sample for analyzing the practice of States, or at least that of the Western industrialized States, as regards the law of the sea. They include major and small maritime powers, coastal and land-locked States, States with coasts on the Atlantic Ocean and States with coasts on semi-enclosed seas such as the Baltic and the Mediterranean, States with and without involvement in deep seabed mining and States with different interests as regards fisheries. The fact that they all belong to the European Union is a very important common feature, which amply justifies the choice made to study them together. The book's aim is to give, through essays prepared by well-known specialists, a detailed survey of the attitudes and practice concerning the law of the sea of the member States of the European Union and of the European Community as such. The common positions of the member States and the results of their coordinated action also emerge from these essays. The fact that the member States and the European Community are now actively engaged in the process of becoming parties to the Law of the Sea Convention is certainly a major contribution to the consolidation of the Convention as a universal instrument, or at least as an instrument widely ratified by States of all continents and economic and political interests.
