Building on case studies from France, Italy, the Empire and the Swiss Confederation, the essays collected by Mathieu Caesar in this volume highlight how factions were formed and how they shaped political society from the late Middle Ages. The authors have especially focused on how political and religious ideologies contributed to the formation of partisanship, the role of propaganda, and the significance and strategies of factional leaders. The volume shows how factions, despite the generally negative view of them held by theologians and jurists, were in practice accepted and used as political tools.

When the Supreme Court of Canada makes a decision that invalidates a statute, it creates a constitutional moment. But does that have a direct and observable impact on public policy? Constraining the Court explores what happens when a statute involving a significant public policy issue – French language rights in Quebec, supervised consumption sites, abortion, or medical assistance in dying – is declared unconstitutional. James B. Kelly examines the conditions under which Parliament or provincial/territorial legislatures attempt to contain the policy impact of judicial invalidation and engage in non-compliance without invoking the notwithstanding clause. He considers the importance of the issue, the unpopularity of a judicial decision, the limited reach of a negative rights instrument such as the Charter, the context of federalism, and the mixture of public and private action behind any legislative response. While the Supreme Court’s importance cannot be denied, this rigorous analysis convincingly concludes that a judicial decision does not necessarily determine a policy outcome.

This book aims to shed light on the roots of sustainability in the Iberian Peninsula that lie in the interrelations between shipbuilding and forestry from the 14th to the 19th centuries, combining various geographical scales (local, regional and national) and different timespans (short-term and long-term studies). Three main themes are discussed in depth here: firstly, the roots of current conservationism in the Iberian Peninsula; the evolution of the forest policies set in motion at the local, regional and national levels to meet the demand for wood and timber; and the long-standing impact of naval empirical forestry on the conservation and transformation of the forest landscape. Therefore, the book attempts, on the one hand, to unravel the forest policies and empirical forestry implemented in the Iberian Peninsula as the roots or origins of what we refer to nowadays as "sustainability", and to assess the contribution of imperial forestry to landscape planning and the conservation of forest resources, on the other, and, finally, to break away from the prevailing theological narrative that shipbuilding was the main agent of forest destruction in the Early Modern Iberian Peninsula, for which both quantitative and qualitative analyses will be conducted. This book analyzes the promotion of subnational identities undertaken by Spanish fascism and the Franco regime between 1930 and 1975, as well as their patterns of survival, accommodation and adaptation. It examines the proactive attitudes of the various actors committed to the dictatorship – from Falangists to Francoist intellectuals to Catholic conservatives – alongside their repressive or annihilating approach to regional cultures and languages. As in most Fascist regimes between 1922 and 1945, a narrative of the ethnocultural, ethnoterritorial and historic diversity of the nation persisted, with differing degrees of intensity and different tendencies. These discourses and practices were not limited exclusively to the ideological and social sphere of anti-Francoism, and the roots of the ‘State of the Autonomous Communities’, which gave rise to the extension of political autonomy to all Spanish regions from 1978 onwards, date back to the deep structure of the dictatorship, with foundations in demands put forward by the local, provincial and regional elites within later Francoism. The volume is primarily written for scholars and students of Iberian Studies, European Modern and Contemporary History, Cultural Studies, especially those with an interest in memory studies, fascism, nationalism and regionalism, cultural resistance under dictatorship, and transitions from dictatorship to democracy.
