N ow, in the 24 years I served in the House, and I went to battle with departments and agencies or the White House over constituent matters, I always had the feeling in the pit of my stomach that as a Congress man, and therefore my colleagues were in the same boat, that we were more of a pain in the neck than an accepted member of a team when dealing with the Executive. When I moved over to the Executive Branch at the State Depart ment, I found that, if anything, that was an understatement on my part, and that there is a very definite institutional resentment in the Executive Branch against what they would consider intrusion from the Legislative Branch, and which in turn the Legislative Branch Members considered their right either through committee jurisdiction or representing their constituents to do battle with the Executive. The functioning of the U.S. government is a bit messier than Americans would like to think. The general understanding of policymaking has Congress making the laws, executive agencies implementing them, and the courts applying the laws as written—as long as those laws are constitutional. Making Policy, Making Law fundamentally challenges this conventional wisdom, arguing that no dominant institution—or even a roughly consistent pattern of relationships—exists among the various players in the federal policymaking process.
