Examining the principle of mutual recognition in the EU legal order this volume asks whether the principle as developed in the internal market, can and should be applied in judicial cooperation in criminal matters in the area of freedom, security, and justice.
This thesis focuses upon VAT in the context of the Community's internal market. Its central aim is to prove that the current EU VAT system is incompatible with the concept of internal market as set out in the EC Treaty and interpreted by the Court of Justice. The study commences with an analysis of the concept of internal market, the main objective of which is to establish the basic legal framework for the proposed thesis. As part of this examination, it is demonstrated that the EC Treaty creates a temporally unlimited obligation for the Community to approve legislation with the aim of establishing and improving the functioning of the internal market. By analysis of existing EU VAT jurisprudence, it is argued that obstacles cannot be overcome through incremental developments emerging from the Court of Justice, but can only be resolved by fundamental and substantive legislative amendment.

The radical changes taking place in the international scene during the late 1980s have presented the European Communities with important new challenges. The twelve Member States agreed that the only way to respond effectively to this new situation was to speed up the European integration process, and in December 1990 two Intergovernmental Conferences were inaugurated, focusing respectively on the development of an Economic and Monetary Union and a Political Union. It was the difficult task of the Luxembourg and Dutch Presidencies to channel the often very diverging positions of the different actors in the process into one coherent set of amendments to the Treaties forming the European Communities. This publication examines the positions which the different Member States, the Commission and the European Parliament have been defending in the Intergovernmental Conference on Political Union and more particularly with regard to one of the most sensitive topics under discussion, namely the development of a Common Foreign and Security Policy (CFSP). The introduction places the debate on the development of a Political Union and a CFSP in an historical perspective and gives an overview of the progression of the negotiations. The concluding chapter presents a general framework for better understanding of the course and results of the negotiations, and a critical evaluation of the outcome. The annexes reproduce the main proposals on the development of a CFSP submitted to the Conference.
World Bank Discussion Paper No. 251. This study investigates the conflicting viewpoints of small- and medium-size enterprises (SMEs) and banks: the SMEs contend that the supply of bank financing is largely unavailable to them, while banks maintain that lending to these enterprises remains low because of lack of demand. Surveys were conducted among enterprises to assess demand and sources of finance, and financial institutions were interviewed to analyze the reasons for constraints on the supply side. Results show that credit is rarely granted for starting a new business. Thus, the smaller the enterprise, the greater the equity finance share of the initial investment. Evidence also suggests that exploitation of highly profitable opportunities could be accelerated by these enterprises if they had greater access to external financing. The study concludes that financial liberalization has had little effect on the access of SMEs to bank credit. It explains why banks have shown little interest in developing these enterprises as a market niche and suggests techniques that banks could adopt to overcome lending risks.
