The judicial administration of France had its origin in the Feudal System. The great nobles ruled their estates side by side with, and not under, the King. With him the great barons exercised ÒhighÓ justice, extending to life and limb. The seigneurs and great clerics dispensed ÒmiddleÓ justice and imposed certain corporal penalties, while the power of ÒlowÓ justice, extending only to the amende and imprisonment, was wielded by smaller jurisdictions. The whole history of France is summed up in the persistent effort of the King to establish an absolute monarchy, and three centuries were passed in a struggle between nobles, parliaments and the eventually supreme ruler. Each jurisdiction was supported by various methods of enforcing its authority: All, however, had their prisons, which served many purposes. The prison was first of all a place of detention and durance where people deemed dangerous might be kept out of the way of doing harm and law-breakers could be called to account for their misdeeds. Accused persons were in it held safely until they could be arraigned before the tribunals, and after conviction by legal process were sentenced to the various penalties in force. The prison was de facto the high road to the scaffold on which the condemned suffered the extreme penalty by one or another of the forms of capital punishment, and death was dealt out indifferently by decapitation, the noose, the stake or the wheel. Too often where proof was weak or wanting, torture was called in to assist in extorting confession of guilt, and again, the same hideous practice was applied to the convicted, either to aggravate their pains or to compel the betrayal of suspected confederates and accomplices. The prison reflected every phase of passing criminality and was the constant home of wrong-doers of all categories, heinous and venial. Offenders against the common law met their just retribution. Many thousands were committed for sins political and non-criminal, the victims of an arbitrary monarch and his high-handed, irresponsible ministers. The prison was the KingÕs castle, his stronghold for the coercion and safe-keeping of all who conspired against his person or threatened his peace. It was a social reformatory in which he disciplined the dissolute and the wastrel, the loose-livers of both sexes, who were thus obliged to run straight and kept out of mischief by the stringent curtailment of their liberty. The prison, last of all, played into the hands of the rich against the poor, active champion of the commercial code, taking the side of creditors by holding all debtors fast until they could satisfy the legal, and at times illegal demands made upon them.

Prisons are on the increase from the United States to China, as ever-larger proportions of humanity find themselves behind bars. While prisons now span the world, we know little about their history in global perspective. Rather than interpreting the prison's proliferation as the predictable result of globalization, Cultures of Confinement underlines the fact that the prison was never simply imposed by colonial powers or copied by elites eager to emulate the West, but was reinvented and transformed by a host of local factors, its success being dependent on its very flexibility. Complex cultural negotiations took place in encounters between different parts of the world, and rather than assigning a passive role to Latin America, Asia, and Africa, the authors of this book point out the acts of resistance or appropriation that altered the social practices associated with confinement. The prison, in short, was understood in culturally specific ways and reinvented in a variety of local contexts examined here for the first time in global perspective.
The Nazi occupation of Europe of World War Two is acknowledged as a defining juncture and an important identity-building experience throughout contemporary Europe. Resistance is what 'saves' European societies from an otherwise chequered record of collaboration on the part of their economic, political, cultural and religious elites. Opposition took pride of place as a legitimizing device in the post-war order and has since become an indelible part of the collective consciousness. Yet there is one exception to this trend among previously occupied territories: the British Channel Islands. Collective identity construction in the islands still relies on the notion of 'orderly and correct relations' with the Germans, while talk of 'resistance' earns raised eyebrows. The general attitude to the many witnesses of conscience who existed in the islands remains ambiguous. This book conversely and expertly argues that there was in fact resistance against the Germans in the Channel Islands and is the first text to fully explore the complex relationship that existed between the Germans and the people of the only part of the British Isles to experience occupation.
For the past four decades, a rich scholarship has investigated the emergence of the prison in Europe and North America, mainly the connection between institutional architecture, techniques of social control, and mechanisms of discipline. Prison Architecture and Punishment in Colonial Senegal asks if these connections did exist in colonial Senegal since prisons in Africa had never been the focus of such scholarship. This book addresses three main themes. First, it analyzes prison buildings and their changing architectural forms throughout the colonial period to highlight how the French used prison architecture to control Africans. Second, it describes the connections between the internal layout of prison spaces and punishment to show how the design of prisons expressed the notions of punishment and reforms. The book also undertakes a critical assessment of inmates’ agency in reshaping the world of prisons in colonial Senegal. Finally, it discusses the legacy of colonial prisons in independent Senegal. By providing a comprehensive history of prison architecture in Senegal, the book helps insert Africa into a more global history by offering a uniquely comparative study of colonialism, architecture, and punishment.
