Le contexte immédiat de la recherche poursuivie dans ce mémoire est une forme de privatisation de la violence publique rendue de plus en plus visible dans la couverture médiatique des guerres contemporaines. Il est aujourd'hui patent que dans nombres de conflits, qu'ils soient internes ou internationaux, les forces militaires constituées par des employés de corporations transnationales sont équivalentes à tous points de vue, y compris en nombre, à des contingents étatiques traditionnels. Ce phénomène a attiré l'attention des médias et de la société civile, particulièrement dans la mesure où ces acteurs privés se sont vus à plusieurs reprises impliqués dans des activités criminelles. L'objet de la recherche entreprise ici est d'encadrer la question des activités militaires privées de ce genre dans le droit international contemporain, et de proposer une synthèse des principaux problèmes juridiques soulevés par ces acteurs et les principales solutions envisagées et envisageables en droit international. La problématique qui guide cette recherche concerne l'effet pour le droit international contemporain de la participation d'acteurs privés, en particulier de sociétés transnationales, dans l'exercice de la violence publique autrefois attribut exclusif du souverain. Plus particulièrement, l'argumentation développée ici est guidée par le défi posé par la privatisation de la guerre pour le droit international humanitaire, le droit international des droits de l'homme et le droit pénal international, qui comme le droit international général dépendent d'une séparation visible des sphères d'activité publique et privée. L'argument met en évidence que les difficultés rencontrées par le droit international face aux activités de ce que l'on appelle les " compagnies militaires privées " dérive de l'ambiguïté plus large avec laquelle le droit international traite les sociétés transnationales. En replaçant la question des " CMP " dans ce cadre plus large, l'argument défendu par la mémo.
