The new government in the DRC is starting to implement its governance programme and planning to revisit the national anti-corruption strategy. The temptation is high to move fast on all fronts but it is important to assess the immediate past and, especially, the transition period from 2003 to 2006, so that lessons which could inform policy decisions can be drawn. This monograph makes a useful contribution to a review of the transition period. It assesses the strengths and weaknesses of the anti-corruption institutions and laws which were in force, evaluating their success or failure and identifying factors that supported or inhibited their effectiveness. It further identifies gaps in national laws and regulations that could be prioritised to make them compliant with international legal instruments. Finally, it makes recommendations about what measures should be prioritised with a view to improving the legal framework and the relevant institutions.

The Democratic Republic of the Congo is one of the main beneficiaries of EU support, with about 1.9 billion euro of assistance provided between 2003 and 2011. In this report, the European Court of Auditors assessed if the Commission and the EEAS managed effectively EU support for governance and whether this support achieved its planned results. It focused on key areas of governance: the electoral process, justice and police, public finance management reforms and the decentralisation process. It concludes that EU support has been set within a generally sound cooperation strategy, addressing main needs, but progress has been slow, uneven and overall limited. Sustainability was an unrealistic prospect for most projects examined. This volume examines the causes and purposes of 'post-conflict' violence. The end of a war is generally expected to be followed by an end to collective violence, as the term ‘post-conflict’ that came into general usage in the 1990s signifies. In reality, however, various forms of deadly violence continue, and sometimes even increase after the big guns have been silenced and a peace agreement signed. Explanations for this and other kinds of violence fall roughly into two broad categories – those that stress the legacies of the war and those that focus on the conditions of the peace. There are significant gaps in the literature, most importantly arising from the common premise that there is one, predominant type of post-war situation. This ‘post-war state’ is often endowed with certain generic features that predispose it towards violence, such as a weak state, criminal elements generated by the war-time economy, demobilized but not demilitarized or reintegrated ex-combatants, impunity and rapid liberalization. The premise of this volume differs. It argues that features which constrain or encourage violence stack up in ways to create distinct and different types of post-war environments. Critical factors that shape the post-war environment in this respect lie in the war-to-peace transition itself, above all the outcome of the war in terms of military and political power and its relationship to social hierarchies of power, normative understandings of the post-war order, and the international context. This book will of much interest to students of war and conflict studies, peacebuilding and IR/Security Studies in general.
