This book examines the South China Sea territorial disputes from the perspective of international order. The authors argue that both China and the US are attempting to impose their respective preferred orders to the region and that the observed disputes are due to the clash of two competing order-building projects. Ordering the maritime space is essential for these two countries to validate their national identities and to achieve ontological security. Because both are ontological security-seeking states, this imperative gives them little room for striking a grand bargain between them. The book focuses on how China and the US engage in practices and discourses that build, contest, and legitimise the two major ordering projects they promote in the region. It concludes that China must act in its legitimation strategy in accordance with contemporary publicly accepted norms and rules to create a legitimate maritime order, while the US should support ASEAN in devising a multilateral resolution of the disputes.

The South China Sea disputes continue to confuse and confound policymakers. All the countries bordering directly on this sea - China, Vietnam, Taiwan, the Philippines, Malaysia, and Brunei - have claimed some or all of the tiny, but strategically located, Spratly Islets and some or all of the maritime space and its resources. All of these claims have serious weaknesses under the principles of international law that govern these issues. This book offers several possible regional interim solutions to the South China Sea disputes. All of the national claims to both islands and ocean space in the region have weaknesses. An interim solution is urgently needed because the status quo is dangerous and unstable, because of unilateral actions by the claimants and continuing opportunities for involvement by outside powers. Division or allocation of the features and ocean space among the competing claimants seem unfeasible because of their sharp disagreements over the boundaries of the area in dispute as well as what would constitute an appropriate equitable division. The authors survey the principles that appear to guide the nations of the South China Sea region in their regional relations, and they identify the appropriate objectives of a regional resource authority. They also identify the political realities of the region, which serve as constraints on the design of a regime. This book explores imperial power and the transnational encounters of shipowners and merchants in the South China Sea from 1840 to 1930. With British Hong Kong and French Indochina on its northern and western shores, the ‘Asian Mediterranean’ was for almost a century a crucible of power and an axis of economic struggle for coastal shipping companies from various nations. Merchant steamers shipped cargoes and passengers between ports of the region. Hong Kong, the global port city, and the colonial ports of Saigon and Haiphong developed into major hubs for the flow of goods and people, while Guangzhouwan survived as an almost forgotten outpost of Indochina. While previous research in this field has largely remained within the confines of colonial history, this book uses the examples of French and German companies operating in the South China Sea to demonstrate the extent to which transnational actors and business networks interacted with imperial power and the process of globalisation.
