Excerpt from Bank Laws (Fourth Other California laws included are the Public Deposit Acts and the Investment Companies Act. Statutes permitting the deposit of State and other public funds in banks against the pledge of State or Municipal bonds were first passed at the 1907 Session of the Legislature. These statutes have unquestionably added' to the attractiveness of public bonds, State and Municipal, as a reserve holding for banks. The principle of these laws appears to be sound and will probably remain a part of the permanent policy of the State. The Investment Companies Act, or Blue Sky Law, as it is popularly termed, enacted at the 1913 Session of the California Legislature, is somewhat of an innovation. This law provides for a State regulation of public offerings of bonds and stocks, and is' designed primarily to prevent the sale of unsafe or fraudulent securities to inexperienced investors. It is hoped that this Law will prove beneficial to conservative dealers in investment securities, through the elimination_ of unscrupulous competition, but until a thorough test is made of its operation and the operation of similar statutes recently enacted, in other states, it will be impossible to judge with any accuracy the practical effect of this legislation. Excerpt from Handbook of the Law of Banks and Banking The object of this book is to present the law of the subject in brief compass, in accordance with the plan of the Hornbook Series. The author has had in view, however, that the sub ject is one that concerns rather practitioners than law stu dents, and for this reason he has covered many questions in the text and notes that might have been omitted, had the book been intended primarily for law students, and he nas made a fuller citation of the decisions than he would other wise have done. The fundamental part of the law of banks and banking relates to the various transactions between banks and bankers and those dealing with them. The author has not entered upon the field of corporation law, except so far as the law of banking corporations seemed to require special discussion, and he has not dealt with the varying statutory provisions of the different states respecting banking corpora tions; but he has endeavored to cover the field of national banks and the National Bank Act, so far as it is affected by the decisions. The National Bank Act and other provisions of the federal statutes relating to national banks are printed in an Appendix, with historical and explanatory notes pre pared by the editorial staff of the publishers. When treating of questions concerning checks and other negotiable instru ments, the author has referred to the Negotiable Instruments Law, and has pointed out the not infrequent changes intro duced by it. Excerpt from The Law of Deposits This volume is prepared for the special use of bankers and their assistants, the bank clerks, whose sincere and active ambition to improve in efficiency never lags, but whose time is so much occupied with the duties crowded upon them that a general law course is impracticable, while the average law book is incomprehensible. It is hoped that business men will also find it useful. The author's purpose has been to make a clear statement of the principles governing the law of deposits, explain statutes and, where there is a conflict, indicate to the reader in each state the law in his jurisdiction or the better practice to follow in view of the conflict. Some cases are cited, a reading of which will be profitable; but a general annotation has been omitted, as it would confuse more than enlighten. Most cases cited will be found to be annotated in the reports, and in the National Reporter System the last case is a key to all earlier ones. While the writer has referred to the standard works on the law of banking, such as Morse, Zane, Bolles and others, he has based most of his statements herein on the decisions of the courts as found in the reports of the cases themselves. It is believed that the statements are fully sustained by the authorities. If the volume is found practical and useful by the banker the author will be more than satisfied. If the legal profession finds it reliable, he will feel well repaid for his labor. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
