Esta monografía de investigación pretende abordar la construcción jurídica del derecho al agua como un derecho fundamental y como un derecho humano, desde la perspectiva del Derecho constitucional. El agua ha sido un tema fundamental desde los inicios de la historia constitucional del país, y si bien la configuración jurídica actual es diferente a la señalada en las constituciones previas a la de 1991, las distintas formas de reconocimiento reflejan los cambios y las necesidades de la sociedad y de la población, que van causando la obligación de precisiones, evolución y sofisticación en el régimen jurídico del agua.
