Practically, however, it is very well known that to a very large extent judicial decisions originate that which they profess only to apply. In books of practice, the conventional theory is rightly ignored: the form is immersed in the matter: instead of the case illustrating the rule, the rule is deduced from the case; and our text-books are, in fact, an index and guide to the Reports. To the beginner, however, the inversion of what might appear to be the natural order of legal study is not a little perplexing. The attention is constantly diverted, and the memory confused, by the necessity of separating the abstract from the concrete. In the present work, which is designed to meet the requirements of the student, I have endeavoured to set forth the first principles of the Common Law in as brief and axiomatic a form as possible, and to each chapter I have appended a short summary of cases, which may serve to illustrate the principal positions laid down in the text. I have adopted the general scope of the great works of Addison, as affording the best existing exposition of the law, in the hope that this merely elementary book may serve as a useful stepping-stone to the study of its more ponderous originals.
