With contributions from several Asia-Pacific countries, this book compares performance and productivity in higher education from the perspective of institutional change. Using multiple methods and datasets and including case studies from Australia, Cambodia, China, Malaysia, India and Japan, the authors focus on shedding light on the efficacy of institutional policies and reforms. The worldwide Gross Enrolment Ratio (GER) in higher education neared 40 per cent in 2020 due to the dramatic increase in enrolments in many developing economies, especially in Asia. This significant increase in the number of students in higher education brings great benefits but requires major ongoing investment by governments around the world. This growth has followed waves of internationalization and marketization, and universities are undergoing substantial change in their organization and character. The goal of many institutional policies and reforms has been better performance and higher productivity. Yet little is known about whether they have achieved this aim. Students, government officials and university leaders all have the right to ask whether the outcomes of higher education justify the costs of running the system. Although increasing attention has been paid to higher education institutions’ management and operation, the study of higher education performance and productivity is still in its relative infancy compared to other enterprises. Academic freedom is one of the fundamental rights as set out in Article 10 of the Federal Constitution. Allah (subhanahu wata’ala) has bestowed every human being the right to develop their minds for the benefit of mankind. Furthermore, with a sound mind, humans can plan their lives by creating and forming certain systems for the development of human capital. Hence, this freedom can shape the effectiveness of the educational system of a country which in turn will have an important impact on the formation of human capital. However, some legal restrictions need to be taken into account in balancing one's rights and freedoms with the common good to ensure the continuity of justice being upheld in a practical way. With the existence of the National Education Philosophy, Malaysia demonstrates a good commitment and is on the right track in driving the development of academic freedom. It should be implemented in a balanced way between fundamental liberties and freedoms with the observance of the principles of law that demand justice in its entirety to ensure the harmony and preservation of national education that can be achieved comprehensively. These principles will be the focus of the study for this paper which will look at how far the concept of academic freedom applies in Malaysia as well as the effectiveness of existing legislation in ensuring that it aligns with the concept of the rule of law as the basis for the enforcement of legal justice in an independent and sovereign country.

This thesis is based on issues concerning the changing landscape of higher education globally and its implication at the local and national levels of the organization of universities. Drawn from the neo-rationalism perspective on the interactions between actors and higher education systems, the 'gigogne' concept of the academic arenas and coupling / decoupling processes, the analysis focuses on the case study of the development, implementation and adjustment of academic workload model. The methodology applied is based on long-term participant observation, action research and case study approaches. It is mixing quantitative analysis of the transformation of the academics' performance and structure with the university's achievement. On the other hand, this quantitative approach is complimented with the qualitative analysis of data gathered through formal interviews and focus groups, conducted with academics, senior management of the university and as well as experts of the higher education system in Malaysia and globally.Conclusions from the findings demonstrate - at the organizational level of the university - the capability of negotiation of the academics and senior management with regards to their roles and conditions of career advancement is central in the instrumentation of the academic workload system. At the national level, it highlights the complementary action between public and private higher education institutions. At the international level, it stresses on the capability of adjustment of the university organization system and the Malaysian higher education policy to redefine itself in regulating its position at the arenas of international bodies in higher education.

As demand for tertiary education continues to rise across Asia, countries are expanding their higher education systems outwards by constructing new universities, hiring more faculty and encouraging private provision.
